. TERMS, CANCELLATION, SUSPENSION & TERMINATION OF MEMBERSHIP

At TBC WELLNESS CENTER LLC. we may suspend or terminate my Membership at any time, in its sole and absolute discretion, for non-payment of Membership Fees or for violation of any of TBC Wellness Center LLC.  policies and procedures by said primary member or secondary member, and that in so doing, TBC Wellness Center LLC. assumes no further liability to adhere to the terms of this Agreement. All Primary and Secondary Memberships of TBC Wellness Center LLC. and payments are due upon the invoicing date. ACH and Automatic Draft Transfers will not be cancelled without a fifteen (15) day written notice, either by certified mail, hand-delivery to the management of TBC WELLNESS CENTER LLC., or by electronic means through our gym management software where the member has an account All membership cancellations must be cancelled by the Primary Member.  All Primary & Secondary Members will receive a key fob and/or electronic Bluetooth token upon initiating this agreement. Primary & Secondary members must return all key fobs upon cancellation of this agreement. Any key fobs not returned to TBC Wellness Center LLC. will incur a $10 fee to be paid immediately by the Primary and/or Secondary Member. Electronic Bluetooth tokens will expire and will not need to be returned.  5

ACCOUNT INFORMATION NOTIFICATIONS & COLLECTIONS OF UNPAID DUES 

Staff from TBC Wellness Center LLC. may contact you via telephone, email, text message or other means from time to time for the purpose of notifying you of issues related to your membership or billing information, for offers that may be of interest to you, or for automatic payment processing issues. By providing us with your contact information and signing this agreement, you give your prior express written consent to receive, at any address or phone number provided to us, membership and billing-related communications from us or our authorized delegate to the extent permitted by applicable law, including without limitation the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act. You acknowledge that calls and text messages may be sent via auto-dialer, and that standard message and data rates may apply. If we do not receive written cancellation and your payment cannot be processed by your financial institution, membership dues will continue to accrue for 60 days. After 60 days of non-payment, we will suspend the account entirely and attempt all reasonable avenues to collect the debt such as calling, e-mailing, texting, or direct certified mail. If our attempts to collect the unpaid amounts are not achieved, we must submit the account and unpaid amounts to a registered collections agency within the State of Michigan to recover the debt. All fees associated with collecting will be at the cost of the Primary Member account who owes the unpaid fee amount to include, but not limited to, membership fees, class fees, attorney fees, and any collection agency fees.  

REFUNDS, NON-PAYMENTS, & LATE FEE POLICY

 No refunds will be given on any completed transaction for memberships processed and performed electronically by any Primary Member. If duplicate memberships are registered by the Primary Member, credits can be applied to  future TBC Wellness Center LLC. membership/classes payments to the Primary Member account when overpayment  was performed by the Primary Member. Refunds will not be given to duplicate accounts created. Credits will be  applied to future month memberships. No refunds will be given on ACH or automatic draft transfer payments not  cancelled within fifteen (15) days. If the request for ACH and automatic debit drafts cancellation does not occur  within fifteen (15) days, the Primary Member and any Secondary Member associated with the Primary Member  account will incur additional monthly membership fees until written notice has been received by TBC Wellness  Center LLC. from the Primary Member requesting the cancellation.  All electronic payments processed by TBC Wellness Center LLC. which are rejected by the Primary Member’s  banking organization due to Primary Membership having insufficient funds in their account will incur a $45 return  payment fee in addition to the membership cost on the invoice.  TBC Wellness Center LLC. invoices 2 weeks in advance prior to any Primary or Secondary Membership due date.  Payment for memberships is due on the invoice due date. TBC Wellness Center LLC. has a 7-day grace period before  additional fees are added to membership or class invoices. After the invoice due date and grace period, a $15 late fee  will be added to the invoice.  Membership access to the TBC Wellness Center LLC. facilities will be restricted for all non-payments after the  invoice due date grace period until the payment has been received by TBC Wellness Center LLC. Upon payment,  access will be restored to TBC Wellness Center LLC. TBC Wellness Center LLC. reserves the right to restrict access  for any reason beyond non-payments, to include violation of the TBC Wellness Center LLC. rules and this agreement.  Under special circumstances refunds can be provided which include death, disability, or relocation of our facility. For  these special circumstances, we will refund to you a pro rata cost of any unused services under this agreement within  30 days. Membership payments can be frozen for medical reasons only.
